Ajovia Terms of Service
Effective Date: February 1, 2026.
Welcome to Ajovia. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Ajovia (“we,” “us,” or “our”) governing your access to and use of our mobile application, website, and any related services (collectively, the “Services”).
By accessing or using Ajovia, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, you must not use the Services.
1. Eligibility
1.1 Age Requirement: You must be at least 13 years old to use Ajovia. If you are under 13, you must obtain the consent of a parent or a guardian before using the Services.
1.2 Compliance: You represent and warrant that you have the legal capacity to enter into this agreement and comply with all applicable laws and regulations.
1.3 Account Responsibility: You are responsible for maintaining the security of your account and ensuring that any registration information you provide is accurate and up to date.
2. User Accounts and Security
2.1 Account Creation: To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information.
2.2 Confidentiality: You are responsible for maintaining the confidentiality of your account credentials. Ajovia is not liable for any unauthorised access to your account.
2.3 Account Termination: We reserve the right to suspend or terminate your account at any time if we determine that you have violated these Terms or engaged in fraudulent, abusive, or unlawful activity.
3. Acceptable Use Policy
By using Ajovia, you agree to:
• Comply with all applicable laws and regulations.
• Treat other users with respect and refrain from harassment, hate speech, or abusive behaviour.
• Avoid posting misleading, false, or harmful content.
• Not engage in spamming, unauthorised advertising, or fraudulent activities.
• Not attempt to disrupt or compromise the security of the Services.
We reserve the right to remove any content or suspend accounts that violate these rules.
4. Content Ownership and Intellectual Property
4.1 User-Generated Content: You retain ownership of any content you post, including images, videos, and text.
4.2 License to Ajovia: By posting content, you grant Ajovia a non-exclusive, worldwide, royalty-free, irrevocable, and sublicensable license to use, reproduce, modify, distribute, and display your content within our platform for operational and promotional purposes.
4.3 Intellectual Property Rights: Ajovia’s trademarks, logos, software, and proprietary content are the exclusive property of Ajovia and may not be used without prior written consent.
5. Transactions and Third-Party Services
5.1 Marketplace Services: Ajovia may provide a marketplace for pet-related products or services. However, we do not endorse, guarantee, or assume responsibility for any third-party offerings.
5.2 User Responsibility: All transactions between users and third-party sellers are solely between the parties involved. Ajovia is not responsible for disputes, refunds, or product quality.
5.3 Fees and Payments: If you purchase services or products through Ajovia, you agree to pay all applicable fees. All payments are final unless otherwise stated.
6. Privacy and Data Protection
6.1 Privacy Policy: Your use of Ajovia is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal data.
6.2 Data Security: While we take reasonable measures to protect your information, we cannot guarantee complete security. You acknowledge that you use Ajovia at your own risk.
7. Disclaimers and Limitation of Liability
7.1 No Warranties: Ajovia is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied.
7.2 Limitation of Liability: To the maximum extent permitted by law, Ajovia shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services.
7.3 User Responsibility: You assume full responsibility for interactions with other users and any reliance on information found within the Services.
8. Termination and Suspension
8.1 Termination by User: You may delete your account at any time. However, certain data may be retained as required by law.
8.2 Termination by Ajovia: We reserve the right to suspend or terminate your access to Ajovia at our sole discretion if we determine that you have violated these Terms.
8.3 Effect of Termination: Upon termination, your right to use the Services will cease immediately. Any provisions that by their nature should survive termination shall remain in effect.
9. Changes to These Terms
9.1 Modification Rights: We may update these Terms from time to time. If changes are made, we will notify you by posting the revised Terms on our platform.
9.2 Continued Use: Your continued use of Ajovia after changes are made constitutes your acceptance of the revised Terms.
10. Governing Law and Dispute Resolution
10.1 Applicable Law: These Terms shall be governed by and construed in accordance with the laws of Nigeria. However, given Ajovia’s international expansion plans, this Agreement shall also be enforceable under applicable international intellectual property and business laws in jurisdictions where Ajovia operates.
10.2 Informal Resolution: Before initiating any formal dispute resolution, you agree to first contact us at info@petopiapets.org to attempt to resolve the issue amicably. We will make reasonable efforts to resolve the dispute within 30 days of receiving notice.
10.3 Arbitration Agreement: If a dispute cannot be resolved informally, it shall be settled through binding arbitration in accordance with the rules of the Lagos Court of Arbitration (LCA) or another recognised arbitration institution in Nigeria. The arbitration shall take place in Lagos, Nigeria, unless both parties agree to a different location. The proceedings shall be conducted in English, and each party shall bear its own costs of arbitration unless otherwise determined by the arbitrator.
10.4 Class Action Waiver: You agree that any disputes will be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Ajovia.
10.5 Exceptions: Notwithstanding the arbitration agreement, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorised use of intellectual property, data breaches, or any violation that may cause irreparable harm.
10.6 Jurisdiction for Non-Arbitrable Disputes: If any dispute is determined to be non-arbitrable, it shall be resolved in the courts of Nigeria. However, in jurisdictions where Ajovia operates, relevant international business and intellectual property laws may also apply, and legal proceedings may take place in those jurisdictions where necessary.
